About Velocity Marketing (Our Role)

Velocity Marketing (“Velocity,” “we,” “our,” or “us”) provides digital marketing and related services, including website design and hosting, SEO, paid advertising, CRM integrations/automations, SMS and email communications, and consulting. By accessing our websites, submitting a form, or using any of our services (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”).

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Services. For details on how we collect and use personal data, see our Privacy Policy

Eligibility, Accounts, and Phone Verification

You must be at least 18 years old to use the Services. To help prevent fraud and to comply with carrier policies, we may require phone verification (e.g., one-time passcodes) and/or validation of brand identity before enabling SMS features. You agree to:

Provide accurate, current information;
Keep login credentials secure;
Promptly update contact info;
Be responsible for all activity under your account.

Your URL clickstreams (the path you take through our site), pages viewed, page response times, download errors, how long you stay on our pages, what you do on those pages, how often, and other actions.

Data on how you use our website

Your mobile phone number; opt-in/consent status; consent method and timestamp; opt-in source (e.g., website form or keyword); limited message metadata (send dates/times, delivery receipts, routing information); opt-out or HELP requests; and enrollment history. We do not sell or share this mobile information for marketing purposes.

SMS Program Data

Lead Qualification, Financial-Capacity Data, and Credit-Related Information

When you submit an inquiry through one of our advertisements, landing pages, websites, application forms, scheduling forms, or other lead-generation channels, we may use the information you provide to verify your identity, evaluate your inquiry, qualify and route your request, and determine which products, services, payment options, or financing options may be appropriate for you.

Information You Provide
Your name;Email address;Telephone number;Mailing or residential address;ZIP code;Information about the product or service you are interested in;Information concerning your project, requested service, budget, or estimated purchase amount;Your responses to qualification questions; andOther information you voluntarily submit through the form.

Credit-Related and Financial-Capacity Information

After you submit your information and provide the required authorization, we and our service providers may use your identifying information to match, obtain, generate, or verify credit-related and financial-capacity information about you.Depending on the services available and the information returned by our providers, this information may include:

A credit score, credit-score range, or credit grade;Creditworthiness indicators;Estimated available revolving credit;Credit-limit or credit-utilization information;Estimated financing capacity or purchasing power;Credit-account or tradeline indicators;Estimated ability to qualify for payment or financing options;Identity-verification and fraud-prevention information; andOther financial qualification, risk, or consumer-report attributes.

We may receive this information even when you do not provide a Social Security number or date of birth. Our service providers may use information such as your name, telephone number, email address, address, and other identifiers to locate and match available records.

SalesKick and Other Service Providers

We use SalesKick and may use other data, identity-verification, consumer-reporting, lead-management, customer-relationship-management, analytics, and qualification providers to operate our forms and evaluate submitted inquiries.These providers may collect information directly through the form, receive information from us, match the submitted information with information from other sources, and return financial qualification or credit-related results to us.The privacy practices of these providers may also be governed by their respective privacy policies and contractual obligations.

How We Use This Information

We may use submitted information and credit-related or financial-capacity information to:Verify that an inquiry is associated with a real person;Evaluate whether you may be financially qualified for our products or services;Determine whether payment plans or financing options may be appropriate;Grade or score the quality of an inquiry;Prioritize, route, assign, or schedule inquiries with our sales representatives;Personalize the products, services, payment options, or offers discussed with you;Determine the appropriate level or method of follow-up;Prevent fraud and misuse of our forms;Improve our sales, customer-service, and lead-management processes;Maintain records of your request and authorization; andComply with legal and regulatory obligations.

Submitting the form does not guarantee approval for financing, a particular credit limit, a particular payment option, or eligibility for any product or service.

Credit Inquiries

The retrieval of credit-related information may involve a soft credit inquiry or another form of consumer-data matching.The inquiry is a soft inquiry, does not affect your credit score, and is not visible to lenders reviewing your credit report.We will not initiate a hard credit inquiry through this initial lead form unless you are separately notified and provide any additional authorization required for that inquiry.

How We Use This Information

Disclosure of Information

We may disclose or make information available to:SalesKick;Consumer reporting agencies and credit-data providers;Identity-verification and fraud-prevention providers;Customer-relationship-management and lead-management providers;Contractors and sales representatives assisting with your inquiry;Financing and payment providers when you request or pursue a financing or payment option;Professional advisers and compliance providers; andGovernment authorities when disclosure is required by law.We may use credit-related and financial-capacity information internally to evaluate and respond to your inquiry. We will not disclose your specific credit score, creditworthiness, available credit, financing capacity, or consumer-report information to advertising platforms for advertising targeting, audience creation, or campaign optimization where prohibited.

Payment and Financing Providers

If you later make a purchase or apply for a payment plan, your payment or financing transaction may be processed by independent third parties such as Stripe, Affirm, or another payment or financing provider.Those providers may separately collect payment, banking, identity, credit, and financial information under their own terms and privacy policies. Any credit inquiry or underwriting performed by those providers is separate from the initial lead-qualification process described above.

Retention and Security

We retain submitted information, authorization records, lead-qualification results, and related records for as long as reasonably necessary to respond to your inquiry, operate our business, prevent fraud, resolve disputes, and comply with legal obligations.

We use reasonable administrative, technical, and physical safeguards designed to protect information under our control. However, no electronic transmission or storage system can be guaranteed to be completely secure.

Eligibility, Accounts, and Phone Verification You agree not to:

Break the law, violate third-party rights, or attempt to breach our systems;
Submit false, misleading, or harmful content;
Send spam, unlawful, or abusive communications;
Upload malware or engage in denial-of-service activity.

We may suspend or terminate access for violations.

Intellectual Property

All site content, software, designs, graphics, copy, and trademarks on our properties are owned by Velocity or our licensors and protected by law. You may not copy, modify, or distribute our materials without written permission. You retain ownership of your own trademarks, content, and data that you supply to us.

Third-Party Links & Services

Our Services may link to or integrate with third-party tools (e.g., Google, Meta, payment processors, SMS carriers). We are not responsible for third-party content, availability, or practices. Your use of third-party services is governed by their terms/policies.

Communications & Consent (General)

By submitting your information via our forms, you consent to receive communications from Velocity by phone, email, or SMS regarding quotes, appointments, service updates, and (if you opt in) promotions. You can opt out of marketing SMS at any time by replying “STOP.” For help, reply “HELP.”

Velocity may send: appointment confirmations, scheduling changes, service notifications, account or policy notices, and occasional promotions related to Velocity.

Opt-In & Phone Number Ownership
You opt in by submitting your number via our forms and checking the consent box (or by other explicit methods we provide). You represent you are the owner or authorized user of the number and consent to receive messages to that number.

Frequency & Fees
Message frequency varies. Message and data rates may apply from your provider.

Opt-Out & Rejoin
Text STOP to end SMS from Velocity. We’ll send a one-time confirmation and stop messaging unless you re-opt in. To rejoin, submit your number and consent again via our form (or original method).

Carrier Liability
Carriers are not liable for delayed or undelivered messages.No Third-Party Sharing of Mobile Data
Mobile information—including text-messaging originator, opt-in data, and consent—will not be shared with third parties or affiliates for marketing/promotional purposes or for any other purpose.

Phone Verification & Quiet Hours

We may use one-time passcodes or call/SMS verification to secure accounts and validate consent. We honor applicable “quiet hours” and do not knowingly send marketing messages during restricted times where required.

A2P 10DLC Registration & Accuracy
To maintain deliverability and compliance with U.S. carriers, Velocity may register its brand/campaigns and maintain records of opt-ins. You agree that any information you provide (brand name, URLs, sample messages) is accurate and not misleading. We do not allow SHAFT content (sex, hate, alcohol to minors, firearms to minors, tobacco to minors) or other CTIA-prohibited content, illegal content, or harassment.

Recordkeeping
We keep consent logs and minimal messaging metadata for 24 months for compliance, then delete or anonymize unless law requires otherwise.

Subscriptions, Payments, and Refunds

Some Services are subscription-based. You authorize recurring charges according to your Order.
Unless the Order states otherwise:
Fees are due in advance and non-refundable once work begins or the billing period starts;
Late payments may incur suspension;
Taxes, pass-through carrier fees, and platform costs (if any) are your responsibility.

If a website is provided under a subscription and the subscription lapses, hosting and maintenance may cease and the site may go offline unless you purchased the site outright or arranged alternative hosting. Title to any deliverable remains with Velocity until all amounts due are paid as specified in your Order.

Results & Disclaimers

Marketing results vary and are influenced by many factors outside our control (market, budget, seasonality, competition, platform policies). We make no guarantees of specific outcomes, rankings, or revenue. Services are provided “as is” and “as available.”

Limitation of Liability

To the maximum extent permitted by law, Velocity and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, revenue, data, or business opportunities, even if advised of the possibility. Our aggregate liability for claims relating to the Services will not exceed the amounts you paid to us for the Services giving rise to the claim in the three (3) months preceding the event.

Some states do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.

Indemnification

You agree to defend, indemnify, and hold harmless Velocity, its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your content or data; (b) your use of the Services; (c) your violation of these Terms or law; or (d) disputes related to your products/services or your end users.

Suspension & Termination

We may suspend or terminate access for suspected violations of these Terms, non-payment, legal/regulatory requirements, or risks to our systems. You may cancel per your Order’s terms (e.g., with 30-days’ notice for monthly subscriptions). Upon termination, your right to use the Services ceases. Sections that by nature should survive (IP, payments, limitation of liability, indemnity, dispute resolution) will survive.

Electronic Communications & E-Sign Consent

You consent to receive agreements, notices, and disclosures electronically (email, website postings, or in-app). You can withdraw consent by contacting support@velocity-marketing.net, though we may be unable to provide some Services without electronic communications.

Changes to the Terms

We may update these Terms from time to time. Updates are effective when posted. Your continued use after changes constitutes acceptance.
